CA LGBTQ Health and Human Services Network Condemns Supreme Court Ruling Undermining Protections Against Conversion Therapy

SACRAMENTO, CA – Today, the California LGBTQ Health and Human Services Network issued a scathing condemnation of the U.S. Supreme Court’s 8-1 ruling in Chiles v. Salazar. The decision, which sides with a Colorado-based counselor, threatens the validity of state-level bans on the discredited and harmful practice of “conversion therapy” by reclassifying medical malpractice as “protected speech.”

By applying “strict scrutiny” to Colorado’s consumer protections, the Court has opened the door for licensed professionals to subject LGBTQ+ youth to practices that every major medical association—including the American Medical Association and American Psychological Association—has denounced as ineffective and deeply psychologically damaging.

Statement from the Director of the CA LGBTQ Health and Human Services Network:

“It was never my intention to share my own story of conversion therapy. However, today’s ruling proves yet again that this administration does not have the best interests of youth in mind.

Conversion therapy is not only abusive, both sexually and psychologically, but it also results in years of suicidal ideation and harmful practices such as cutting and self-flagellation. It has taken me over 20 years to reach a place where I feel comfortable talking about my experiences and being honest that everything I went through was, and is, abuse, which is no fault of my sexuality or gender identity.

No child should have to struggle with whether they are worth staying alive. No child should wonder if their authentic self is better off dead. No child should ever have to struggle in silence and choose suicide. I strongly condemn this ruling, and The Network is dedicated to advocating for safe therapeutic practices that honor the child and who they truly are.”

This ruling creates a dangerous precedent, potentially eroding the ability of states to regulate the quality and safety of healthcare provided to minors. Research continues to show that LGBTQ+ youth subjected to conversion therapy are more than twice as likely to attempt suicide compared to those who are not.

Despite this judicial setback, the Network remains steadfast in its mission. Efforts such as Senate Bill 934 (Wiener), which expand pathways to justice for survivors, are more urgent than ever. California must continue to lead in protecting LGBTQ+ communities. We will continue to fight for the dignity of our youth and ensure that California remains a sanctuary for those seeking life-affirming, evidence-based care.
