AB 1856 expressly provides that under the Fair Employment and Housing Act (FEHA), a non-supervisorial employees may be held civilly liable for harassment based on race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, age, or sexual orientation perpetrated against another employee, an applicant for employment, or a person providing services under a contract.
